Application and Interpretation of the Act (Division 1)

The act has got its objective structure from the enabling provision provided as a right in Article 35 to 40 of the Civil Code concerned with the protection of Personal Information.

The act prohibits Collection, Holding, Using or Communicating to third person any Personal Information. By this terminology we understand that PIPA-Alberta and PIPEDA speak of Collection, Use and disclosure of Personal information so somewhere this act of Quebec is wider in its object. The nature of the medium of Personal Information has also been listed under this act which is written, graphic, taped, filmed, computerized or any other medium. 

Non-Application of the Act

The act does not apply to the personal information for journalistic, historical or genealogical collected, held, used or communicated for legitimate purposes of the public.   

Personal Information (Division II)

Personal Information means any information pertaining to a natural person who is identified by such information.

Exclusion of this Act

The act explicitly excludes public bodies, the documents held by public bodies.
