Functions of the European Data Protection Board under GDPR-Part I

Under article 70 of the GDPR there are some tasks provided which the Board is required to ensure the consistent application under GDPR, hence, the Board must on its own initiative or when its required upon the request of the Commission perform the following tasks-

  1. Monitor and ensure the correct application of GDPR in the cases provided for in article 64 and 65 without prejudice to the tasks of national supervisory authorities;
  1. Advise the Commission on any issue regarding to the protection of personal data in the Union, including on any proposed amendment of GDPR; 
  1. Advise the Commision on the format and procedures for the exchange of information between controllers, processors and supervisory authorities for binding the corporate rules;
  1. Issuance of guidelines, recommendations and best practices in order to encourage consistent application of GDPR;
  1. Issue guidelines, recommendations and best practices for establishing the personal data breaches and determining the undue delay and specify the particular instances in which a controller or a processor is required to notify the personal data breach;
  1. Issue guidelines, recommendations and best practices as regard to the circumstances in which a personal data breach is likely to result in a high risk to the rights and freedoms of the natural persons.       
  1. Issue guidelines, recommendations and best practices for the purpose of further specifying the criteria and requirements for personal data transfer based on binding corporate rules adhered to by processor and or further necessary requirements to ensure the protection of personal data of the concerned data subject;
  1. Issue opinion on draft decisions of supervisory authorities pursuant to consistency mechanism and issue binding decisions.
