The Personal Data Protection Bill, 2019- Analysis & Overview, Part-2

Since the subject matter of our topic is still not enacted by the legislature and it is in the Bill form as introduced in the Lok Sabha, I would like to discuss the same in its current form and I’ll try posting and updating the progress/comments/recommendation pertaining to this Bill.

The Bill has a total of 98 potential sections divided between/among XIV chapters and one schedule. The aim & purpose paragraph of the Bill clarifies that “creating a relationship of trust between persons and entities processing the personal data” will be protected under this act. It further says that the right to privacy is a fundamental right and protecting personal data is necessary as an essential facet of informational privacy.

The Bill in its clarificatory paragraph indicates towards the following kind of situations where it aims to take care of and they are-

  1. Protection of Personal Data
  2. Specify the flow and usage of Personal Data
  3. Create a trust between persons and entities processing the personal data
  4. Protect the processed data
  5. Creation of organizational framework & technical measures in processing the data
  6. Laying down the norms for social media intermediary
  7. Cross border transfer
  8. Accountability of organizations who are processing the personal data
  9. Remedies for harmful and unauthorized processing
  10. Establishment of Data Protection Authority of India
  11. Any connected or incident matters therewith

I firmly believe that without reading the whole statutes one can easily understand the crux of the statutes by just reading the purpose/object statements or paragraphs and to some extent the task of reading & understanding eases the whole process of learning.
