Joint Parliamentary Committee- Personal Data Protection Bill, 2019- Part 1

After the historical judgement of K.S. Puttaswamy (Retd.) Vs. Union of India (SC 2017) wherein the court ruled that the Right to privacy is a Fundamental Right u/art.21 of Part III of the Constitution, thereafter, the Ministry of Electronic & Information Technology (hereinafter “MeiTy”) formed a committee in order to study the issues related to data protection in India. The committee was chaired by retired Supreme Court judge Justice B. N. Srikrishna. The Committee submitted the draft in July, 2018 thereafter on 4th December 2019 the Bill was approved by the Cabinet Ministry of India.

On 11th December 2019 the Personal Data Protection Bill, 2019 was tabled in the Lok Sabha. 

Currently the Bill is being analyzed by the Joint Parliamentary Committee (JCP) along with stakeholders and experts. The JPC is headed by BJP’s MP Mrs. Meenakshi Lekhi (a lawyer & Alma Mater of the Hindu College & University of Delhi). The panel has 20 members from Lok Sabha & 10 from Rajya Sabha.  Earlier the Bill was to be discussed in Budget session but by moving a motion it has been extended to upcoming Monsoon session 202.
